Suzuki vinson 500, throttle stuck, wreck

Just bought a 2004 Suzuki Vinson 500 4x4 (automatic),  put about 2.5 hours on it.  Went riding on a trail I knew very well with a friend; I was leading came up on a rutted hill going down so we crawled down the hill at about 2 mph, the rut got wide on the right so the front right tire went down into the rut, started coming out of the rut and the throttle stuck wide open.  The quad threw me to the right ran over my leg and took off down the trail about 60 yards at about 40-50mph then steered off into the trees and pretty much totaled itself.  It was a very shocking and terrifying experience.  HAd to goto the hospital for X-rays luckily no breaks.


I took the quad back to the dealership they took it and said that Suzuki will have to inspect it before doing anything.  I've talked to a friend who is a lawyer and he said they should be more than willing to get me a new one and pay for my doctor bills, if not he said he would be more than willing to sue Suzuki or the dealership for defect.


I hope Suzuki will take care of me and this doesn't have to goto court.  Has this happened to anyone else?  What happened if it did?

I've got 1200 miles on my '03 Vinson and have NEVER had any throttle problems. I hope you got your legal and physical problems solved w/out a law suit. We don't need prices getting jacked up..............

Does a vinson have an electronic throttle positioner?

Being that my body has low voltage electricity, yes, it has an electronic throttle position sensor-MY THUMB! Seriously, this sounds like a "lawyer baited" question, and we, the ATV CORE, don't need, or want, any more litigation. Call your dealer. No satisfaction? Call, or write, Suzuki! I haven't had an ounce of trouble out of my Vinson-GREAT QUAD! I hate, that you did.
